Terms of Service

Please read these Terms of Service ("Terms") carefully before using ResortTribe ("Service", "Platform") operated by ResortTribe, Inc. ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using ResortTribe, you confirm that you are at least 18 years of age and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

ResortTribe is an online platform that connects travelers with campgrounds, RV parks, and outdoor recreation properties. We provide booking, communication, and management tools for both guests and campground operators.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these Terms.

4. Bookings and Cancellations

  • Guest Bookings: Reservations are subject to the cancellation policy of the individual property. Review cancellation terms before booking.
  • Campground Operators: Operators are responsible for honoring confirmed reservations and maintaining accurate availability calendars.
  • Platform Role: ResortTribe acts as a marketplace. We are not a party to the agreement between guests and campground operators unless otherwise stated.

5. Payments

Payments are processed securely through our payment provider (Stripe). By making a purchase, you authorize us to charge your payment method for the stated amount. All fees are displayed prior to checkout. Refunds are governed by the property's cancellation policy.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Post false, misleading, or fraudulent content
  • Harass, threaten, or harm other users
  • Attempt to gain unauthorized access to any portion of the Service
  • Use automated tools to scrape or extract data without permission
  • Circumvent or disable any security features of the Service

7. User Content

By submitting reviews, photos, or other content to ResortTribe, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with the Service. You represent that you have the right to grant this license and that your content does not violate the rights of any third party.

8. Intellectual Property

All content, features, and functionality of the Service (excluding user-submitted content) are owned by ResortTribe, Inc. and are protected by applicable copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Property listings are provided by third-party operators; we do not warrant the accuracy of property descriptions, amenities, or availability.

10. Limitation of Liability

To the fullest extent permitted by law, ResortTribe, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless ResortTribe, Inc., its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service immediately ceases.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
